Privacy Policy

This is the Privacy Policy of LUXX United GmbH, Ronheider Berg 225, 52076 Aachen, Germany, registered in the commercial register of the local court of Aachen under HRB 22056 (hereinafter referred to as “we”), for the use of the website www.luxxprofile.com (hereinafter referred to as “LUXXplatform”).

We are – with the University of Luxemburg – the co-author of the so-called “LUXXprofile”, a standardized psychological personality test (hereinafter referred to as “Test”), which is available on the LUXXplatform. The use of the LUXXprofile is performed by accessing individual tests in such form that your “Master” provides you with a link through which you can perform the test on the LUXXplatform.

This policy serves to inform “you” as the user of the LUXXplatform about the nature, scope and purpose of our collecting, storing and using your personal data when you use the LUXXplatform, and to seek your consent to do so. We collect, store and use all data in accordance with statutory regulations and do not pass them on to third parties without your consent.

In the following you will learn which data we collect and how we deal with it. Please read the following policy carefully before granting your consent, without which it is impossible to perform the test.

1. ADMISSIBILITY OF DATA PROCESSING

1.1 According to the Federal Data Protection Act (BDSG), data processing and use is permitted provided the BDSG or another law allows it or if the individual has consented thereto. The BDSG allows data processing and use should this happen in the context of the purpose of a contract or a similar relationship of trust. Data processing is also allowed insofar as its purpose is to protect the legitimate interests of the storage office or that of a third party, e.g., the receiver, is mandatory and there is no reason to believe that the legitimate interests of persons concerned outweigh the exclusion of processing or use, or that they hold such legitimate interests.

1.2 “We” as the provider of the LUXXplatform, i.e. the LUXX United GmbH, Ronheider Berg 225, 52076 Aachen, Germany, registered in the commercial register of the local court of Aachen under HRB 22056, shall be the responsible office pursuant to BDSG (see Legal Notice).

2. DATA COLLECTION AND STORAGE

2.1 We oblige to comply with the statutory data protection provisions and to exclusively use all your personal data, which becomes available to us in connection with the performance of the test (i.e. title, name, address, e-mail address, birth date, test results and the data named in Sec. 2.2, hereinafter collectively referred to as the “Data”), for the purpose of performing our and your Master’s service in connection with the Test, to not pass them on to any third party but your Master, and to protect them from the access and knowledge of third parties in accordance with the latest technological standard.

2.2 Data that becomes available to us also includes usage data (e.g. data on your use of the LUXXplatform, incl. your IP address, which we require for your local allocation to your Master, and other data that you voluntarily enter in the LUXXplatform, particularly your answers to the test questions and the test results as well as any other information that we might request from you and that you give us on a voluntary basis).

2.3 Within the framework of performing our service (conducting the test and establishing the test results) we also collect and process data that allow conclusions about your personality (so-called special categories of personal data). We pay special attention to the protection of such sensitive data; your test results are stored separately from your other data.

2.4 You grant your consent that we and your Master may collect, process and use the data that you enter in the registration process and during the performance of the test for the purpose of establishing, performing, amending and executing the contractual relationship.

3. DATA USE AND TRANSFER

3.1 Your data will be used by us or your Master for the transfer of information that you request from us or your Master, for the performance of the test, and for the transfer of the test results.

3.2 You grant your consent that (a) we may transfer your data to your Master, or vice versa, (b) the process of transferring your data within the framework of support by your Master necessarily requires to process and transfer data that allows conclusions about your personality, and (c) we may use your data for the purpose of scientific evaluation or studies, or for an appropriate design of the LUXXplatform in anonymized form or by using pseudonyms, and transfer them – also in anonymized form or by using pseudonyms – to third parties for scientific, market research or marketing purposes.

3.3 Such consent in accordance with Sec. 3.2 a) includes the use of your data by the Master and its exchange between your Master and us by way of the Master accessing the LUXXplatform and your data stored there, including in particular access and evaluation of the Test by your Master and the use of your test results generated thereby for the discussion and explanation of the Tests in advance and the evaluation of the test results afterwards.

3.4 We and your Master also use your e-mail address for our own marketing activities, e.g. sending newsletters by e-mail, provided that you have granted us consent to do so. By registering for our newsletter, which you need to confirm through the so called “Double-Opt-In”- process, you grant your consent to the use of your first name, last name and e-mail address for promotional purposes, i.e. such newsletters will only be sent to you by us or your Master.
Your consent to receive a newsletter by e-mail is revocable free of charge at any time. In each newsletter, you will find a link which allows withdrawing your consent.   You can also unsubscribe from receiving the newsletter at any time via phone, mail or fax. Please use the contact information as shown in our Legal Notice , or the contact information of your Master.

3.5 The online offer of the LUXXplatform uses cookies should you accept their use. Cookies placed by us do not contain any personal data. “Cookies” are text files stored on your computer which help us analyze the use of the LUXXplatform. We use cookies insofar as you accept them via your browser.

4. INFORMATION, CORRECTION AND DELETION OF DATA

4.1 According to the BDSG, you shall be entitled under certain circumstances to free correction, blocking and deletion of your stored data in our files. Please contact us for any questions in this regard (see Legal Notice).

4.2 Upon request, we correct, block or delete your personal data in accordance with § 35 BDSG. Your personal data stored will be deleted when you revoke your consent to such storage, when knowledge of such data is no longer required for the purpose for which is was stored, or when storage is or becomes inadmissible for any other legal reasons.

4.3 You may revoke your consent to this Privacy Policy and to the collection, processing and use of your data at any time with effect to the future. You may send such revocation in any form, incl. per e-mail, to the contact details as listed in the Legal Notice , i.e. you may revoke your declaration of consent at any time by sending your revocation per mail to LUXX United GmbH, Ronheider Berg 225, 52076 Aachen, Germany, per fax or per e-mail to privacy@luxxprofile.com.

4.4 In any case, you shall be entitled to free information about your data stored at all times. You may send a respective information request in any form, incl. per e-mail, to the contact details as listed in the Legal Notice . In your request you need to specify precisely the kind of data that you request information about.

5. GOOGLE ANALYTICS

5.1The LUXXplatform uses Google Analytics, a web analytics service provided by Google Inc. (“Google“). Google Analytics also uses “cookies” insofar as you accept them via your browser, and stores them on your computer to help analyze how you use the LUXXplatform. The information about your use of the website generated by the cookie will be transmitted to and stored by Google on servers in the United States. In case IP anonymization is activated on the LUXXplatform, your IP address will be truncated within the member states of the European Union or other members of the European Economic Area. Only in exceptional cases shall the full IP address be submitted to a Google server in the USA and truncated there.

5.2. Google will use the information of your use of the LUXXplatform on our behalf to evaluate your use of the LUXXplatform, compile reports on website activity, and provide other services relating to the website activity and internet usage for us.

5.3. The IP address that your browser transmits within the scope of Google Analytics will not be associated with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser. You should be however aware that this may prevent your use of the full functionality of the LUXXplatform. You can also prevent the collection of data generated by the cookie and related to your use of the LUXXplatform (including your IP address) for Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de

5.4 In view of the current discussion about the use of analytic tools with complete IP addresses we use Google Analytics with the extension “_anonymizeIp()”. This ensures that IP addresses are only processed in truncated form in order to exclude a direct allocation to the user.

5.5 By using the LUXXplatform you declare your consent to the processing of data collected in the manner and for the purpose described above.

6. SOCIAL NETWORKS

6.1 The LUXXplatform uses social plugins („Plugins”) of and links to the following social networks:

– Facebook
– XING
– LinkedIn
– Google+
– Twitter
– Flickr
-YouTube

We use these plugins and links to make it easier for you to share and discover content relevant to the LUXXprofile. You can identify the plugins by the logo of the respective social network.

6.2 When you open a page of the LUXXplatform containing such a plugin, and click on the plugin, your browser establishes a direct connection with the servers of the respective social network. The content of the plugin, e.g. the so-called “Like”-button by Facebook is directly transferred from the respective social network to your browser, which integrates such content in the page of the LUXXplatform. Therefore, we have no influence on the scope of data that the respective social network collects with the help of the plugin, and inform you on the basis of our current information as follows:

(a) By integrating the plugin the respective social network receives the information that you have opened the respective page on the LUXXplatform. For example, if you are logged in with Facebook, Facebook can allocate the page visit to your Facebook account (the same applies to all other social networks mentioned). When you interact with the plugins, for example by clicking on the “Like”-button by Facebook or writing a comment in Facebook, the respective information is directly transferred from your browser to Facebook and stored there; if you are not a member of Facebook, there is still the possibility that Facebook (at least) receives and stores your IP address (the same applies to all other social networks mentioned).

(b) You may gather information on the purpose and scope of the collection, processing and use of your data by the respective social network, as well as your respective rights and settings to protect your privacy, in the respective privacy policy of the social network.

(c) If you don’t want Facebook to collect data from you via the LUXXplatform, you have to log out from Facebook bevor you visit the LUXXplatform. You may also block the Facebook social plugins with so-called “add-ons” to your browser, for example with a so-called “Facebook Blocker” (to our knowledge, the same applies to all other social networks mentioned).

7. RIGHT OF MODIFICATION

Since we are constantly developing our services, we reserve the right to modify this Privacy Policy at any time in accordance with the applicable statutory provisions. We will announce modifications on our website in due time and collect your new consent, if necessary. Notwithstanding the above, you should regularly read this Privacy Policy in order to be informed of the current status.

8. MISCELLANEOUS

Under certain circumstances we may publish links to the websites of third parties on the LUXXplatform (for example to the social networks mentioned in Sec. 6). Even though we select these third-party websites diligently, we cannot guarantee that the contents and privacy policies displayed on these websites are correct and complete. Therefore, this Privacy Policy does not cover the privacy practices of external websites linked to our website, i.e. we cannot guarantee that these third-party websites do not store data about your visit on these websites.
